New Wells

A Well for which drilling commenced on or after September 1, 2009.

Before any new well may be drilled or completed it must be registered with the District and receive specific authorization to commence drilling.

  • New Exempt wells must only be registered and meet spacing and completion requirements to obtain drilling authorization.
  • New Non-Exempt wells must be registered; must meet spacing and completion requirements or apply for and obtain a variance; and application must be made for all appropriate permits and authorizations required by the District Rules
  • Any lawn irrigation system: (1) installed after September 1, 2009, or (2) for which ownership of the well supplying groundwater to the system changes after September 1, 2009 shall obtain a permit from the district prior to producing water from the well for such an irrigation system.

New Exempt Wells
The drilling or operation of a New domestic, livestock or poultry use well to be located on a tract of land 10 (ten) acres or larger and that is drilled, completed or equipped so that it is incapable of producing more than 25,000 gallons of groundwater per 24-hour interval  (17.36 gallons per minute)

The drilling or operation of a New domestic, livestock or poultry use well to be located on a tract of land smaller than 10 (ten) acres if the tract was platted, qualified for an exception to platting or was otherwise lawfully configured as a tract less than 10 (ten) acres in size before September 1, 2009 and the tract is not divided into smaller tracts of land at any time between September 1, 2009 and the date the drilling of the well commences; and that is drilled, completed or equipped so that it is incapable of producing more than 25,000 gallons of groundwater per 24-hour interval  (17.36 gallons per minute)

New Non-Exempt Wells
A new well that does not qualify for the new exempt well status under the rules.

New Lawn Irrigation Systems
Domestic use for essential irrigation of lawns or other landscaped areas by sprinkler or other irrigation system, whether above ground or below ground, permanent or temporary (other than hand-held hose or single sprinkler attached to a garden hose).
